Agreement

By downloading or using Beneath ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

Description of Service

Beneath is an iOS application that provides underwater soundscapes for sleep, focus, and relaxation. The App is developed by Joshua Heiland.

Subscriptions

The App offers optional paid subscriptions (monthly and yearly) that unlock additional content. Subscriptions are billed through your Apple ID account and managed by Apple's App Store.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel subscriptions in your App Store account settings.

Refunds are handled by Apple according to their refund policies.

Intellectual Property

All content in the App, including all audio files, soundscapes, visuals, and design, is the sole property of Joshua Heiland and is protected by copyright law.

Audio Content License

The audio content in Beneath is licensed to you solely for personal listening within the App. You may not, under any circumstances:

  • Record, capture, extract, download, or rip any audio from the App
  • Sample, remix, or incorporate any audio into other works
  • Redistribute, upload, broadcast, or publicly perform any audio from the App
  • Use any audio from the App in videos, podcasts, streams, or any other media
  • Use any audio from the App for commercial or non-commercial purposes outside of the App

All rights not explicitly granted are reserved. Any use of the audio content outside of personal listening within the App is a violation of these Terms and may result in termination of your access.

Acceptable Use

You agree not to:

  • Reverse-engineer, decompile, or disassemble the App
  • Copy, modify, or distribute any of the App's content
  • Attempt to extract or access the App's underlying audio files or assets
  • Use the App for any unlawful purpose
  • Attempt to interfere with the App's operation

Disclaimers

The App is provided "as is" without warranties of any kind. Beneath is not a medical device and is not intended to diagnose, treat, or cure any condition. The sounds provided are for relaxation and entertainment purposes.

Limitation of Liability

To the fullest extent permitted by law, Joshua Heiland shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
